Allegations

The complaint alleges that the employer misclassified drivers as independent contractors and willfully failed to pay overtime compensation for hours worked beyond daily and weekly thresholds. It further alleges that the employer paid drivers a daily rate and regularly failed to pay at least minimum wage for all hours worked, including off-the-clock work. It further alleges that the employer failed to authorize and permit compliant paid rest periods and failed to pay premium pay for non-compliant rest periods. It further alleges that the employer failed to provide compliant meal periods and did not pay premium pay for meal periods that were not provided. It further alleges that the employer required drivers to incur job-related expenses such as gasoline, insurance, maintenance, mileage and cell phone costs without full reimbursement.
