Allegations

The complaint alleges that the employer failed to pay overtime at the proper rate because bonuses, incentives and other pay were not factored into the regular rate, and employees worked overtime hours without proper pay. It further alleges that the employer failed to provide lawful, timely, uninterrupted meal periods and failed to pay premium pay when meal periods were not provided. It further alleges that the employer failed to authorize and permit lawful rest periods and failed to pay premium pay when rest periods were not provided. It further alleges that the employer failed to furnish accurate itemized wage statements and failed to keep accurate payroll and time records. It further alleges that the employer willfully failed to pay all earned wages at discharge or within the required time after employees quit. It further alleges that the employer failed to pay sick leave at the proper rate by not including incentives, bonuses and other pay in the regular rate.
