Allegations

The complaint alleges that the employer had a policy and practice of failing to provide full, timely, uninterrupted meal periods, including late first meals, no second meal on long shifts, and interrupted or shortened meal periods. It further alleges that the employer had a policy and practice of failing to authorize and permit compliant rest breaks, including due to understaffing and no third break on long shifts. It further alleges that the employer failed to pay all overtime, including by miscalculating the regular rate of pay and not paying double time or for off-the-clock work. It further alleges that the employer failed to pay minimum wages for all hours worked, including unpaid time donning and doffing gear and work performed off the clock. It further alleges that the employer failed to provide accurate itemized wage statements, including incorrect overtime rates, gross wages, hours worked, and missing premium payments. It further alleges that the employer willfully failed to pay all accrued wages to discharged or quitting employees at the time of discharge or within the required time after quitting.
