Allegations

The complaint alleges that the employer maintained an illegal rounding policy, required off-the-clock work, and failed to include incentive pay in the regular rate, resulting in unpaid overtime to non-exempt employees. It further alleges that the employer required non-exempt employees to delay, shorten or skip meal periods, lacked a second meal break policy, and failed to pay full meal period premiums. It further alleges that the employer required non-exempt employees to work through rest periods, imposed productivity quotas that did not account for rest periods, and failed to pay full rest period premiums. It further alleges that the employer failed to pay minimum wages for all hours worked because of an illegal rounding policy and a practice of requiring off-the-clock work. It further alleges that the employer failed to provide complete and accurate wage statements, including omitting hours worked and the proper overtime rate. It further alleges that the employer failed to reimburse employees required to work from home for necessary business expenses such as equipment, internet and cell phone use.
