Allegations

The complaint alleges that the employer did not make available timely, compliant meal periods to non-exempt employees, who were too busy or understaffed to take them, and did not pay premium pay for missed or untimely meal breaks. It further alleges that the employer did not authorize, permit or make available timely rest breaks, required employees to remain on duty during rest periods, and did not pay premium pay for missed rest periods. It further alleges that the employer required employees to provide their own tools, equipment and protective gear and failed to reimburse necessary business expenses. It further alleges that the employer failed to provide accurate itemized wage statements because they omit premium pay for missed or untimely meal breaks. It further alleges that the employer failed to pay all wages owed, including premium pay and expense reimbursements, at the end of employment, exposing it to waiting time penalties.
