Allegations

The complaint alleges that the employer required employees to remain on call and work through meal breaks, denying off-duty meal periods and failing to pay premium compensation for missed meals. It further alleges that the employer required employees to remain on call and work through rest breaks, denying off-duty rest periods and failing to pay premium compensation for missed rests. It further alleges that the employer did not properly calculate or pay overtime wages to non-exempt employees as a corporate-wide practice. It further alleges that the employer issued inaccurate itemized wage statements that did not show accurate gross and net wages and listed the base rate instead of the overtime rate. It further alleges that the employer willfully failed to pay all wages due to discharged or resigning employees at separation, exposing it to waiting-time penalties.
