Allegations

The complaint alleges that the employer misclassified delivery drivers as independent contractors and failed to pay legally required overtime wages for hours worked beyond daily and weekly limits. It further alleges that the employer failed to pay at least minimum wage for all hours worked, including off-the-clock work, because drivers were misclassified and paid on a piece-rate basis. It further alleges that the employer required drivers to work during meal periods, did not relieve them of duty for compliant meal breaks, and did not pay meal period premiums. It further alleges that the employer never told drivers they could take rest breaks, did not authorize or permit compliant rest periods, and did not pay rest period premiums. It further alleges that the employer failed to fully reimburse drivers for necessary business-related expenses such as gas, maintenance, repairs, and uniforms.
