Allegations

The complaint alleges that the employer issued inaccurate itemized wage statements that misstated overtime rates, gross and net wages, and hours worked, and omitted required rate and hours information. It further alleges that the employer willfully failed to pay all wages owed upon separation of employment, exposing it to waiting time penalties. It further alleges that the employer paid sick time at the base hourly rate rather than the correct regular rate that includes non-discretionary bonuses and commissions, underpaying sick pay.
