The complaint alleges that the employer required non-exempt employees to remain on duty during rest periods, did not authorize or permit compliant rest breaks, and did not pay premium pay for missed rest periods. It further alleges that the employer failed to make available timely, compliant first and second meal periods to non-exempt employees and did not pay premium pay for missed or untimely meal breaks. It further alleges that the employer failed to reimburse employees for necessary business expenses such as uniforms, equipment, protective equipment and use of personal cell phones. It further alleges that the employer failed to provide accurate itemized wage statements because they omit premium pay for missed or untimely meal breaks. It further alleges that the employer failed to pay all wages owed upon separation, including premium pay and reimbursements, exposing it to waiting time penalties.
