Allegations

The complaint alleges that the employer required, permitted or suffered non-exempt employees to take shortened meal periods or work through them, and failed to provide required meal periods or the premium pay owed. It further alleges that the employer failed to provide required rest periods to non-exempt employees and failed to pay the additional compensation owed for missed rest periods. It further alleges that the employer failed to pay overtime at the required premium rates and required or permitted off-the-clock work, so employees were not paid for all overtime hours worked. It further alleges that the employer knowingly and intentionally failed to provide timely, accurate itemized wage statements that accurately listed total hours worked. It further alleges that the employer failed to indemnify employees for necessary business expenses incurred in discharging their duties, including uniforms and cell phone usage.
