Allegations

The complaint alleges that the employer requires employees to remain on duty during rest periods, denies timely rest breaks, and does not pay premium pay for missed rest periods. It further alleges that the employer does not permit compliant meal periods, requires employees to clock out yet remain on duty during meal breaks, and does not pay premium pay for missed or untimely meal breaks. It further alleges that the employer requires off-the-clock work, unlawfully rounds time, and fails to pay overtime at the correct regular rate of pay by excluding non-discretionary incentive compensation. It further alleges that the employer does not reimburse employees for business expenses such as personal cell phone use, scrubs, and protective equipment. It further alleges that the employer failed to provide accurate itemized wage statements because they omit premium pay for missed or untimely breaks. It further alleges that the employer fails to pay all wages, including premium pay, owed to employees at the end of their employment, subjecting it to waiting time penalties.
