The complaint alleges that the employer failed to provide timely, uninterrupted meal periods to non-exempt operating room nurses and failed to pay premium wages for late or missed meal periods. It further alleges that the employer failed to furnish accurate itemized wage statements showing meal period premiums owed and paid, including listing an incorrect rate of pay for premiums. It further alleges that the employer willfully failed to pay all wages owed, including meal period premiums, in final paychecks to separated employees, giving rise to waiting time penalties.
