Allegations

The complaint alleges that the employer failed to include non-discretionary incentive compensation in the regular rate of pay when calculating overtime, resulting in underpaid overtime wages to non-exempt employees. It further alleges that the employer failed to provide off-duty meal periods, requiring non-exempt employees to work through meals or with interruptions without premium pay. It further alleges that the employer denied non-exempt employees compliant rest periods and maintained a rule barring them from leaving the premises during rest periods, without paying premium wages. It further alleges that the employer failed to accurately calculate and pay minimum wages, including for off-the-clock work and uneven rounding of time worked. It further alleges that the employer failed to provide accurate itemized wage statements showing correct gross and net wages, total hours worked, and rates of pay. It further alleges that the employer required employees to use their personal cellular phones for work and failed to reimburse them for the associated business expenses.
