The complaint alleges that the employer had a consistent policy of failing to pay overtime wages to non-exempt distribution center employees, using invalid alternative workweek schedules to avoid paying daily overtime. It further alleges that the employer failed to provide accurate itemized wage statements and to keep and provide accurate payroll records for non-exempt employees. It further alleges that the employer required employees to report for work by checking a scheduling app, then did not put them to work for at least half of their scheduled shift and paid no reporting time pay. It further alleges that the employer required employees to use personal cell phones for its scheduling app and failed to reimburse them for the resulting data usage costs. It further alleges that the employer willfully failed to timely pay overtime compensation owed to employees whose employment ended, making it liable for waiting time penalties.
